2008 – 2009 GRAIN POLICY

SCALE INFO:  Customer shall advise the scale operator of ownership and splits required for load being delivered, prior to dumping grain.  Customer should check tickets for correct names and splits before leaving elevator.  It is the Elevators policy that empty trucks are to be given the right of way at the scale.

STORAGE:  All grain will be considered open storage grain, unless customer states grain is to be applied to an open delivery contract within 15 days of delivery, or applied for spot sale at time of delivery.  Storage will be computed on the weighted average of all loads delivered.  Storage rates for the 2008-2009 year will be $.001 per bushel per day for corn. Soybeans will be $.001315 per bushel per day. Corn placed into open storage will receive an additional shrink of 1%. There will be no minimum storage charge. The Elevator reserves the right to limit storage space available at harvest time.

WAREHOUSE RECEIPTS:  All storage, handling, and transportation charges shall be paid in advance for all grain placed under loan.  Elevator reserves the right to issue warehouse receipts either local or in a terminal position at its option.

CONTRACTED GRAIN:  All grain delivered by a customer having an open delivery contract shall be unloaded against said contract, unless customer states grain is to be sold at the spot price at the time of delivery.  In no circumstances will grain be placed into open storage prior to filling an open delivery contract.  All contracted grain delivered prior to the delivery period of said contract shall be considered stored grain and shall be charged storage from the date of delivery until first day of delivery period, unless otherwise agreed on by the Elevator and customer.

GROUND PILES:  The Elevator reserves the right to refuse to pile grain on the ground.  If the elevator accepts grain to be piled on the ground, the Elevator reserves the right to take an additional shrink of 2% to cover expenses and the customer may be forced to sell the grain at the prevailing spot price at the time of delivery.  The Elevator reserves the right to withhold part or all of the payment to the customer for grain piled on the ground until grain is picked up and shipped.  (Nebraska warehousing law prohibits storage grain to be piled on the ground, our insurance will not cover grain piled on the ground, and our lender will not advance funds against grain piled on the ground.)

DEFERRED PAYMENT CONTRACTS:  This contract is available to all customers at the time of settlement.  If you wish to defer payment until a later date, please let us know.

GRAIN SETTLEMENTS:  If a lien exists on the customers’ grain, checks will be issued jointly to the customer and lien holder.

DISCOUNTS:  Market discounts for all grade factors will be taken at time of settlement.  All grain will be “house graded” and such grade will apply.  If a customer wishes to dispute the house grade, a sample will be sent to an official inspection location for a state grade, provided the customer requests such grade at time of delivery.  No sample of customer’s grain will be kept after customer leaves the Elevator’s premises.  All costs incurred by the Elevator to obtain an official grade for the customer shall be at the expense of the customer.

SPIKED LOADS:  Any load of grain received by Elevator that appears to contain a portion of off-grade grain will be discounted on the total load, according to the levels of gradable factors found in the off-grade portion of the load.

HANDLING CHARGES:  There will be an “in & out” charge of 20 cents per bushel for all open storage grain loaded out of elevator by the customer.  Customer is also responsible for all storage charges that have accrued from date of delivery through date loaded out.

ELEVATOR HOURS:  The elevator hours will be posted on a daily basis
